Covenants/Common Interest Developments:
Property in common interest
developments (such as condo associations) or private neighborhoods often is
subject to restrictive covenants. These covenants, sometimes known as
covenants, conditions, and restrictions (or "CC&R's"), can
restrict the use of property and, thus, can give rise to litigation.
The Los Angeles Times recently
reported about Mr. Collins' case on behalf of residents in a private
neighborhood who thought their restrictive covenants prohibited commercial
uses. When a high-end celebrity drug rehab facility moved in, the
residents learned to their disappointment of a state law that overrides such
covenants in some circumstances.
